- In terms or this document “hosting” includes but is not limited to the storage of files within web space provided by TheSender.co.uk on the world wide web “the internet” in the form of a web site and the use of any services connected with that including email services, FTP and other web application and services that may be made available to the users of this service. Further the term spam refers to both unsolicited bulk emails and unsolicited commercial emails as well as messages sent to those who have specifically requested not to be contacted by the sender.
- By making use of TheSender.co.uk’s, herein to be known as “us” or “TheSender”, hosting services you agree to the terms set out below. By your acceptance of the terms below you also agree to accept the general terms of TheSender as specified on our web site.
- You also agree never to cause us to breach the terms of our contract with our hosting supplier. You also accept all responsibility for any breaches caused both in terms or responsibility and financial burden.
- You agree that you will not abuse the service that is provided to you and that any abuse will result in action being taken. You will be responsible for any expenses incurred by you or us as a result of your abuse of the service provided.
- You agree that you will only use the service for the hosting of a web site and not as a file storage facility in whole or part. It should be noted that this does not preclude your web site from supplying downloads however they must be incidental to the web site. TheSender reserves the right to deem any user or specific file as not fulfilling this term at their own discretion. Consultation form TheSender may be sought if the user feels there may be issue with his term or is unsure of how they may be affected by it.
- You accept that you will only use the service within the constraints of the law both as set down in the United Kingdom and the United States of America. This includes but is not limited to hosting of copyright content without permission and other breeches of intellectual property laws.
- This service may not be used for the hosting of any kind of pornographic or adult content in any shape or form. It should be noted however that if a user is unsure of whether their content may be classified as adult they may contact TheSender for clarification.
- Users may not host paid adverts on their sites without the permission of TheSender. Users may also not use their sites to generate monetary income without the permission of TheSender.
- Users may a no point make it appear that their sites are endorsed by or affiliated with TheSender. Users should, in case of issue ensure it is known that their site is in no way affiliated with or endorsed by TheSender.
- The user accepts that they have a limited amount of resources and that if they at any point exceed this amount or resources TheSender may make any and all attempts to suspend access to the service and may as a result of continued abuse cease providing the service (see term 4). Users will normally be informed that they have exceed their limits on resources and will be given the opportunity to right this problem, however TheSender reserves the right to suspend or cease service provision immediately at their own discretion.
- No user will at any time utilise any of the resources provided by TheSender for the sending of ’spam’ or any activity connected with the sending of ’spam’, this includes but is not limited to the collection of email addresses for anything other than opt-in mailing specifically agreed to by the recipient and sent by the person collecting the address or the sending of messages to recipients who have not specifically agreed to be contacted by the sender. Further any such mailing must contain a clear and simple method of unsubscribing from such mailing lists and any requests to cease the send of messages from any address must be heeded. Breaching of this term will lead to immediate and permanent cessation of service provision and may result in the details of such accounts being passed to appropriate authorities.
- Users accept that these conditions as well as those general conditions of TheSender and any other agreements listed in this document may be updated at any time without notification and users should check conditions regularly for changes and should cease using the service if they no longer agree to the terms set out.
